Terms and Conditions

1. Acceptance of Terms

By accessing or using Mobincube ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Service. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify registered users of material changes via email or in-app notification.

2. Description of the Service

Mobincube is an AI-powered platform that enables users to create native mobile applications (Android and iOS) through natural language prompts. The Service generates source code, builds application binaries, and provides related tools for app development and distribution.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

Inactive accounts: Accounts that have had no activity for a period of three (3) consecutive months may be deleted, along with all associated data and projects. This does not apply to accounts with an active paid subscription. We will attempt to notify you via email before deleting an inactive account.

4. AI-Generated Content and Token Consumption

Applications created through the Service are generated by artificial intelligence models. This process requires the consumption of tokens (credits). By using the Service, you acknowledge and accept the following:

• Unpredictable consumption: It is not possible to determine in advance how many tokens will be required to create or modify an application. The amount of tokens consumed depends on multiple factors, including but not limited to: the complexity of the application, the nature and scope of changes requested, errors detected during generation, and the level of detail provided in the prompts.
• No completion guarantee: The consumption of a specific amount of tokens does not guarantee that an application will be fully completed or that a particular feature will be successfully implemented. AI-generated outputs may require further iterations and additional token usage.
• Automatic error resolution: Build errors, compilation failures, or deployment issues may trigger automatic token consumption for error diagnosis and resolution. This process may involve multiple iterations until the errors are resolved. These automatic consumption cycles are an inherent part of the AI-assisted development process.
• Quality of output: While the Service strives to produce high-quality code, AI-generated content may contain errors, bugs, or suboptimal implementations. You are responsible for reviewing and testing any generated code before deploying it to production environments.

5. Payments and Refunds

Token purchases are processed through Stripe. All payments are final and non-refundable once tokens have been credited to your account, except as required by applicable law. Purchased tokens do not expire.

Subscription plans renew automatically at the end of each billing period. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No prorated refunds will be issued for partial billing periods.

6. Intellectual Property

You retain ownership of the content and prompts you provide to the Service. You are granted a license to use, modify, and distribute the source code generated by the Service for your applications.

The Service itself, including its underlying technology, algorithms, user interface, and branding, remains the exclusive property of Mobincube and its licensors.

7. Acceptable Use

You agree not to use the Service to:

• Create applications that violate any applicable laws or regulations.
• Generate malicious software, malware, or applications designed to harm users.
• Infringe upon the intellectual property rights of third parties.
• Distribute harmful, fraudulent, or deceptive content.
• Attempt to circumvent usage limits, security measures, or access controls.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice and without refund.

8. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any generated code will be free of defects.

To the maximum extent permitted by law, Mobincube shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from or related to the use of the Service, regardless of the cause of action or theory of liability.

9. Data and Privacy

We collect and process personal data in accordance with applicable data protection laws. Your prompts and generated code may be processed by third-party AI providers to deliver the Service. We do not sell your personal data to third parties. You may request deletion of your account and associated data at any time through your account settings.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, intellectual property, and dispute resolution) shall remain in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising from these Terms or the use of the Service shall be submitted to the exclusive jurisdiction of the courts of Barcelona, Spain.
